M’n’M Promotional Products – Terms and Conditions
1. These Terms and Conditions apply to all orders.
2. Payment Terms:a. Payment shall be made in full within 30 days of date of invoice, unless special settlement terms have been agreed by us in writing.
b. Standard Terms for new accounts are 14 days from date of invoice for first invoicec. Bespoke Products require 50% deposit prior to production.
3. Any discount offered are on the strict understanding that accounts are paid by the due date. We reserve the right to invoice any such discounts to accounts which become overdue.
4. Passing of Title and Risk:a.The risk in the goods shall pass to you on delivery
b.All goods delivered or not, remain our property until payment is received in full.5. Products: We reserve the right to alter any details or design of products illustrated without notice and while every effort is made to describe goods accurately in the catalogue / website no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description and any resulting loss.
6. Quotations and contracts: Orders are accepted subject to adjust prices quoted to take account of any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise. Quotations are valid for 30 days (with the exception of items containing memory chips for which prices are valid for 5 working days).7. Delivery: Every effort will be made to deliver on time, but any delivery day specified us a best estimate and no liability is accepted for any loss arising from delay or error in the delivery of goods.
8. Quantity Variation: We shall be deemed to have fulfilled our contract by delivery of a quantity within 10% plus or minus of the quantity ordered and you will be charged at the contract rate for the quantity delivered. 9. Claims:a.Claims arising from damages, delay or partial loss in transit must be made in writing so as to reach us within 5 working days of delivery.
b.All claims with regard to the quality or quantity of the goods shall be made in writing so as to reach us within 5 working days of receipt of goods or such goods shall be deemed to comply as to quality and quantity with the terms of the contract.c. All goods must be examined at point of delivery. We shall not be liable for any loss arising from damage caused to the goods in transit unless loss or damage is noted on the delivery note at the time of delivery.
10. Liability:a.Save in so far as defects in the goods cause death, injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.
b.We can accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the notification of claims procedure set out in clause 9.11. Cancellation Charges: An administration charge will be made on all cancelled orders together with the charge for all artwork carried out up to the date of written cancellation.
12. Samples: Samples will be provided as required and will be charged at the end column rate if not returned in good condition within 14 days.13. Quantity Changes to Orders: Any changes in quantity ordered must be made in writing prior to commencement of processing. Any increase in the order must be regarded as a separate contract unless written notification is received before work commences on the original order.
14. Artwork / Printing: Unless stated otherwise, all prices included printing one colour in one location from print ready artwork (supplied in EPS, Corel, Quark or Illustrator format). For additional positions or colours please contact us for an exact quotation. Where embroidery is included in unit costs, this is limited to 5000 stitches. Designs with a greater stitch count will incur a surcharge. Pantone matching will usually incur a small additional charge.15. Origination: Prices exclude the origination costs for artwork (Screens, Set-up, blocking dies, Embroidery disks etc). These are all charged at additional costs. In most cases, each product requires a separate origination charge as the screens etc are not transferable between different products. Please contact us if you require further information regarding this.
16. Small orders: Where you require a quantity smaller than the minimum shown, this is normally possible but usually carries a small order surcharge.17. Unbranded Goods: Unbranded products will be supplied at a discount, which will vary according to the item and quantity. Please enquire for further details.
18. VAT: All prices shown / quoted are exclusive of VAT which will be charged at the current rate.Please note: Products within the catalogue / website displaying names or trademarks are not necessarily indicative of supply or endorsement by the owner of the trademark. They are merely representatives of what can be achieved with branded promotional merchandise.
